Terms and Conditions

Dark Patterns is a trade name of Kleine Vogel Holding B.V., registered at Beethovenplein 10, 1077 WM Amsterdam. CoC: 92220908. This is not the collection address; the collection address will be provided upon booking.

1. Definitions

In these terms and conditions:

  • Lessor: Kleine Vogel Holding B.V., trading as Dark Patterns.
  • Lessee: the natural or legal person renting equipment.
  • Equipment: the rented SOX fixtures, lamps, and associated parts.
  • Rental period: the agreed rental period, starting on the day of collection.
  • Replacement value: fixed at €650 per fixture (including lamp). SOX lamps and fixtures are no longer in production.

2. Applicability

These terms apply to all quotes, agreements, and deliveries by Dark Patterns. Deviations are only valid if agreed in writing. By placing a booking, the lessee accepts these terms.

3. Agreement and right of withdrawal

The rental agreement is formed when the lessor confirms the booking in writing. The rental constitutes a leisure service for a specific date or period. Pursuant to article 6:230p(f) of the Dutch Civil Code, the right of withdrawal does not apply. By confirming the booking, the lessee acknowledges this.

4. Pricing and payment

  • The rental price is €225 per day for the complete set of four fixtures, VAT included. Multi-day rates on request.
  • Payment is due in advance unless otherwise agreed in writing.
  • Late payment constitutes default by operation of law. Statutory interest is due on the outstanding amount.

5. Deposit

  • A deposit of €200 is due upon collection.
  • The deposit is refunded upon timely return of undamaged equipment.
  • The lessor may offset the deposit against costs for damage, loss, late return, or cleaning. If costs exceed the deposit, the lessee remains liable for the remaining amount.

6. Collection, transport, and return

  • Collection and return take place exclusively at the lessor's address in Amsterdam-Oost, at a pre-arranged time.
  • The lessee is responsible for transport. Each fixture weighs 9.5 kg; a car is required.
  • Equipment must be transported in a closed vehicle or car boot. Transport on an open trailer or bicycle is not permitted.
  • Equipment must be returned no later than the last day of the rental period, unless otherwise agreed in writing.
  • Late return incurs the daily rental rate plus 50% for each day of delay.

7. Inspection upon collection

The lessee is deemed to have inspected the equipment for defects upon collection. Any defects must be reported on the spot. By taking the equipment, the lessee confirms it was received in good working condition.

8. Ownership

The equipment remains the property of the lessor at all times. The lessee may not sell, lend, pledge, sublet, or otherwise make the equipment available to third parties without the lessor's prior written consent.

9. Use and duty of care

  • The lessee uses the equipment in accordance with its intended purpose and the lessor's instructions.
  • The equipment may not be left unattended. A responsible person must be present at all times when the lamps are in use.
  • SOX lamps have a warm-up time of 10–15 minutes. Frequent switching on and off significantly shortens lamp life and is not permitted.
  • Fixtures may not be opened, disassembled, or modified.
  • Repairs by the lessee are not permitted unless expressly agreed in writing.
  • The lessee is responsible for the safety of the space in which the equipment is used, including adequate ventilation, preventing contact with flammable materials, and stable placement.
  • For outdoor use, the lessee must ensure adequate protection from precipitation and wind.

10. Damage reporting

In case of malfunction, damage, or loss, the lessee must notify the lessor immediately. Failure to report damage or defects in a timely manner renders the lessee fully liable for all consequential damage.

11. Insurance

The equipment is not insured from the moment it leaves the lessor's address. The lessee is obliged to arrange adequate insurance against theft, loss, fire, vandalism, and damage to the equipment for the entire rental period.

12. Risk and liability

  • From the moment of collection until return, the lessee bears full risk for the equipment, regardless of the cause of damage or loss.
  • In case of damage or loss, the lessee is liable for the replacement value (see article 1).
  • The lessor is not liable for any direct or indirect damage resulting from the use of the equipment, including but not limited to damage caused by improper use, leaving equipment unattended, unsupervised use, or equipment defects.
  • The lessee indemnifies the lessor against all third-party claims related to the use of the equipment during the rental period.

13. Cancellation

  • Free cancellation is possible up to 48 hours before the agreed collection date.
  • Cancellation within 48 hours incurs 50% of the rental price.
  • No-show without notice incurs the full rental price.

14. Force majeure

In case of force majeure, neither party is obliged to perform under the agreement. Force majeure includes but is not limited to: lamp defects, illness, government measures, transport issues, and extreme weather conditions. The lessor is not liable for damage resulting from force majeure.

15. Applicable law and disputes

These terms and all agreements are governed exclusively by Dutch law. Disputes shall be submitted to the competent court in Amsterdam.

Privacy Statement

1. Controller

Kleine Vogel Holding B.V. (Dark Patterns), Beethovenplein 10, 1077 WM Amsterdam, CoC 92220908, is the controller responsible for the processing of personal data as described in this statement.

2. What data and why

We only process data you provide to us when placing a booking:

  • Name and contact details (phone number, email address): to communicate about your booking.
  • Requested rental date(s): to schedule the rental.
  • Payment details: to process payment and deposit.

Legal basis: performance of the rental agreement (art. 6(1)(b) GDPR).

3. Retention period

We do not retain your data longer than necessary. Booking data is kept for a maximum of 12 months after the rental period ends, unless a longer period is required by law (e.g. 7-year fiscal retention obligation for financial records).

4. Sharing with third parties

We do not share your data with third parties unless necessary for the performance of the agreement (e.g. a payment service provider) or required by law.

5. Cookies and tracking

This website does not use cookies and does not employ any tracking or analytics software.

6. Your rights

Under the GDPR you have the right to access, rectify, erase, and port your data, and the right to object to processing. You can submit a request via the contact details on this site. You also have the right to lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens).
